Conditions of use

Use of The American Musical Instrument Society, Inc. (AMIS) website (www.amis.org) constitutes agreement to our terms of use.  We encourage you to review the following information carefully.

Trademarks

The AMIS and other marks indicated on our site are trademarks owned exclusively by AMIS.  The use of these trademarks and trade dress is prohibited if used in connection with the sale of any product that does not belong to AMIS, in any manner that seeks to disparage or discredit AMIS or in any manner that may cause confusion among our members or the public.

Copyright

All content on this website is the exclusive property of AMIS.  Said content includes text, graphics, logos, icons, images, audio and video clips, digital downloads, and software. Our content is protected by United States and international copyright laws and we reserve all rights contained therein. In case of dispute or infringement, we will rigorously defend our rights to this material.

License and site access

The AMIS grants you (the user) a limited license to access and make personal use of this website.  This license does not include the right to download any material (other than routine page caching), modify any material, or any portion thereof, without the express written consent of AMIS.  This license excludes the download or collection of logos, product descriptions, pricing, text, graphics, and audio and video clips not otherwise explicitly granted. This website or any portion of this website may not be reproduced, duplicated, copied, sold, visited, or otherwise exploited for any commercial purpose without express written permission of AMIS.  Any unauthorized use of this website voids the limited license granted by AMIS.

Content submitted by site users

If you do post content to this site or otherwise submit material (including, but not limited to, photographs and testimonials), you grant AMIS and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.  By your submission you represent and warrant that you own or otherwise control all of the rights to the content that you post, that the content is accurate, that use of the content you supply does not violate this policy and will not cause injury to any person or entity, and that you will indemnify AMIS or its affiliates for all claims resulting from content you supply. AMIS reserves the right to remove any content at our sole discretion.

Limitation of liability

This site is provided by AMIS on an “as is” and “as available” basis.  AMIS makes no warranties, either expressed or implied, as to the operation of the site or the content contained therein.  You expressly agree that your use of www.amis.org is at your own risk.

AMIS cannot warrant that this site, our servers, or e-mail communications affiliated with the use of this website, are free from viruses. AMIS will not be responsible for any damages of any kind resulting from use of this website, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

Applicable law

By visiting www.amis.org, you agree that the laws of the state of New York, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and AMIS.

Changes in policy

AMIS reserves the right to modify, alter, delete, and update these policies at any time we see fit.  Such alternations do not nullify our rights if infringements or breaches occurred under a previous version of these conditions.

STATEMENT OF PRIVACY

The American Musical Instrument Society (AMIS) is committed to protecting your privacy. This statement of privacy applies to the AMIS website and governs data collection and usage at all AMIS sites and services; it does not apply to other online or offline sites, products, or services. The website, www.amis.org, is intended for users of all ages. Personal information of all users, if collected, is used and disclosed as described in this statement.

Collection of personal information

As an e-commerce website, AMIS collects personal information, such as your e-mail address, name, and home or work address or telephone number only if you explicitly provide this information using a form. Information collected by AMIS is used solely for the accuracy of the membership database. Credit card transactions are provided by a secure third party and information provided to them is not collected by AMIS.

This website uses Google Analytics to help analyze how users use the site. The tool uses “cookies,” which are text files placed on your computer, to collect standard internet log information and visitor behavior information in an anonymous form. The information generated by the cookie about your use of the website (including IP address) is transmitted to Google. This information is then used to evaluate visitors’ use of the website and to compile statistical reports on website activity for AMIS.

AMIS will never (and will not allow any third party to) use the statistical analytics tool to track or to collect any Personally Identifiable Information (PII) of visitors to the AMIS website. Google will not associate your IP address with any other data held by Google. Neither AMIS nor Google will link, or seek to link, an IP address with the identity of a computer user. We will not associate any data gathered from this site with any Personally Identifiable Information from any source, unless you explicitly submit that information via a fill-in form on our website.

AMIS encourages you to review the privacy statements of websites you choose to link to from the AMIS website so that you can understand how those websites collect, use, and share your information. We are not responsible for the privacy statements or other content on websites outside of the AMIS website.

Use of your personal information

AMIS and its operational service partners collect and use your personal information to process membership data. AMIS may occasionally hire other companies to provide limited services on our
behalf, such as handling the processing and delivery of mailings, providing member support, or processing transactions. We will provide those companies with only the personal information they need to deliver their services. They are required to maintain the confidentiality of your information and are prohibited from using that information for any other purpose.

AMIS does not use or collect sensitive personal information, such as race, religion, or political affiliations.

AMIS may access and/or disclose your personal information if required to do so by law or in the good faith belief that such action is necessary to:

  1. conform to the edicts of the law or comply with legal process served on AMIS or the website;

  2. protect and defend the rights or property of AMIS, including its website; or

  3. act under exigent circumstances to protect the personal safety of users of the AMIS website or the public.

REFUND POLICY

Refunds are not available for cancelled memberships in The American Musical Instrument Society, Inc. (AMIS), except in extreme situations. If such situations arise, the Executive Committee of the Board of Governors will decide each situation individually.
